Notice is hereby given of the adoption of a Local Law No 23-2010. “A LOCAL LAW AMENDING CHAPTER 203 OF THE TOWN OF AMHERST CODE, KNOWN AS THE ZONING ORDINANCE, TO REZONE 4125 Rensch Road FROM RD TO MFR-6 AND TO AMEND THE ZONING MAP ACCORDINGLY. This Local Law was adopted at the Town Board meeting held at the Amherst Municipal Building, 5583 Main Street. Williamsville, NY 14221 on October 17, 2011.

The property for which this classification is amending is a follows:

The Town Board hereby amends its zoning map which is incorporated by reference in the Town zoning code by amending from Research and Development District (“RD”) to Multi Family Residential District Six (“MFR-6), the parcel 4125 Rensch Road, subject to any conditions imposed by the authorizing resolution legally; described as follows:

THE TOWN OF AMHERST,

THE ZONING ORDINANCE, AS

ADOPTED BY LOCAL LAW 6-2006,

AMENDING SECTIONS 5 AND 6.

PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Amherst on December 12, 2011 at 7:00 p.m., prevailing time, at the Amherst Municipal Building, 5583 Main Street, Williamsville, New York 14221, to hear all persons interested in the amendment to Sections 5 and 6 of the Town of Amherst Zoning Code; and to evaluate the potential environmental impacts associated with the proposed action pursuant to Article 8 of the Environmental Conservation Law of the State of New York and its implementing regulations (collectively know as “State Environmental Quality Review Act” (SEQRA)) and Chapter 104 of the Code of the Town of Amherst.

Be it enacted by the Town Board of the Town of Amherst as follows: Section 1. Title

This Local Law shall be referred to as, “A Local Law Making Amendments To Chapter 203 Of The Code Of The Town Of Amherst, The Zoning Ordinance As Adopted By Local Law 6-2006, Amending Sections 5 and 6”. Section 2.

Section 5 of Chapter 203 of the Code of the Town of Amherst is revised as follows:

1. §5-7-2 A(3) Revise as follows:

“The following uses, if allowed the underlying zoning, shall be considered allowable uses within the –TNB overlay and must meet the requirements of §5-7-6 and §6-4.”

2. §5-7-2 B Revise table headings to add Subzone ‘3’ after Subzone ‘1’

3. §3.5-7-3B Revise to add “§5-7-2B above and must meet the requirements of §6-8”

4. §5-7-5 A In the parking requirements table, delete the following:

“Retail sales and service not exceeding 2,000 sf. . .4 per 1,000 sf

5. §5-7-6 B Delete §5-7-6 B and add the following as §6-4-10 D:

D. TNB Overlay District, Subzones ‘1’, ‘2’, and ‘3’

(1) The design of any fuel canopy structure shall relate in form, materials, color and architectural style to the principal structure on the premises.

(2) The design of the fuel canopy shall employ a non-illuminated fascia. Signage shall be of similar style, color and materials as signage on the principal structure.

(3) The design of the fuel island canopy shall include fully recessed lighting arranged and shielded so that the sources or lenses of such illumination are not visible from any street or adjoining property. The lighting levels shall comply with the requirements of §7-3-4.

6. §5-7-6 C Delete §5-7-6 C and add the following as §6-4-5.

§6-4-5 Farm Equipment Sales or Service and House and Camping

Trailer Sales

Farm equipment sales or service or house and camping trailer sales, when permitted in a TNB Overlay District, shall comply with the following standards:

(1) No vehicle storage, display or parking shall be permitted between the principal structure and front lot line.

(2) No service bay or garage doors shall face the street.

(3) Display vehicles shall be arranged in an orderly fashion and provide reasonable room for pedestrian and vehicular maneuvering. Section 3.

Section 6 of Chapter 203 of the Code of the Town of Amherst is revised as follows:

1. §6-4 Update all cross-references throughout the Zoning Code to the following sections:

6-4-5 to 6-4-6 (Laundromat, Cleaning and Dyeing Outlets and Pickup Stations)

6-4-6 to 6-4-7 (Media Store with Some Sexually Oriented Media)

6-4-7 to 6-4-8 (Private Parking Facility)

6-4-8 to 6-4-9 (Restaurant with Outdoor Dining)

6-4-9 to 6-4-10 (Service Station)

6-4-10 to 6-4-11 (Vehicle Parts Sales)

6-4-11 to 6-4-12 (Vehicle Sales, Rental, Leasing and Related Repair)

§6-4-10 Revise as follows:

This Local Law is adopted under the authority granted to the Town Board of the Town of Amherst pursuant to §§10(1)(ii)(a)(12), 20 and 27 of the Municipal Home Rule Law and §265 of the Town Law of the State of New York.

The invalidity of any provision of this Local Law shall not affect the validity of any other provision of this Local Law that can be given effect without such invalid provision. Section 5. Effective Date

This Local Law shall take effect immediately and be filed in the Office of the Secretary of State in accordance with Section 27 of the Municipal Home Rule Law and published pursuant to Sections 130 and 133 of the Town Law and Chapter 28 of the Code of the Town of Amherst.

PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Amherst on December 12, 2011 at 7 p.m., prevailing time, at the Amherst Municipal Building, 5583 Main Street, Williamsville, New York 14221, to hear all persons interested in following: (1) A proposed amendment of the Bicentennial Comprehensive Plan to the extent that the proposed zoning changes in the proposed local law/ordinance are inconsistent therewith; (2) a proposed Local Law/Ordinance that would amend the zoning classification of the property described herein as depicted on the Official Zoning Map from CF to OB and (3) to evaluate the potential environmental impacts associated with the proposed action consisting of the above referenced requests to amend the Town of Amherst Bicentennial Comprehensive Plan and the Official Zoning Map pursuant to Article 8 of the Environmental Conservation Law of the State of New York and its implementing regulations (collectively know as “State Environmental Quality Review Act” (SEQRA)) and Chapter 104 of the Code of the Town of Amherst.

ALL THAT TRACT OR PARCEL OF LAND, situate in the Town of Amherst, County of Erie and State of New York, being part of Lot No. 9, Township 12 Range 7 of the Holland Land Company’s Survey, intended to be a strip of land twenty-five (25') feet in width and being further bounded and described as follows: Beginning at the southwest corner of lands conveyed to Niagara Mohawk Power Corporation by deeds dated November 2, 1964 and recorded in the Erie County Clerk’s office in Liber 7056 of Deeds at pages 564 and 573; thence north 87 degrees 54' east along the south line of the above described parcel 20.02 feet to a point; thence south 31 degrees 40'-17" west 88.42 feet (deed) 89.57 feet (measured) to the northerly line of Park Club Lane Extension, said line also being the northerly line of property appropriated by the State of New York for interstate route connection No. 590-1-2, Powerline Expressway, Section 2, Parcel No. 587, which appropriation was recorded in the Erie County Clerk’s Office in Liber 6690 of Deeds at page 26; thence northwesterly along said northerly line on a curve to the left having a radius of 243.00 feet, an arc distance of 25.04 feet (deed) 25.02 feet (measured) to a point; thence north 31 degrees 40'-17" east 91.09 feet (deed) 91.66 feet (measured) to the west line of the above described parcel; thence south 2 degrees 06' east along said west line 15.04 feet to the point of beginning.

This notice is provided pursuant to New York State Municipal Home Rule §20, Town Law §§ 130, 264 and 272-a, as well as §8-2 of the Town of Amherst Zoning Ordinance and Chapter 28 of the Code of the Town of Amherst.
